2015: Fresh litigation against Jonathan commences

by Tunde Oyesina A fresh legal battle seeking to stop President Goodluck Jonathan from contesting in the 2015 general election commenced on Wednesday before a Federal High Court sitting in Abuja.
The plaintiff, Henry Amadi, had through his counsel, C.N Eke, approached the court seeking its order restraining Jonathan from contesting for the office of the President of Nigeria at the end of his current term of office in 2015.
Joined as second defendant is the Independent National Electoral Commission (INEC).
The plaintiff is seeking for a declaration that having taken the oaths prescribed in section 140(1)&(2) of the constitution on two previous occasions, the first defendant is not qualified to contest as candidate for election to the office of the President of the Federal Republic of Nigeria in 2015.
He further wants the court to restrain INEC from accepting any nomination of the first defendant as candidate for election to the office of President of the Federal Republic of Nigeria under any party’s platform at the expiration of his current term.
He averred in his 17- paragraph affidavit that, “in recent time there has been a clamour by several persons urging the first defendant to contest the election again to the office of the President of the Federal Republic of Nigeria at the expiration of the current term in May 2015.
“I know as of fact that the first defendant is very likely to win the said election if he heeds the clamour to stand as candidate in that election given his popularity and the factor of incumbency.”
Amadi contended that if Jonathan is eventually elected to the office of president in 2015, he would spend more time in office than the period envisaged by the constitution.
President Jonathan has, however, filed a notice of preliminary objection through his counsel, Ade Okeaya-Inneh SAN.
Jonathan submitted that the originating process by which the action was commenced was invalid for non compliance with the provisions of Order 3 Rule 12(3) and Order 7 Rule 1 of the Federal High Court(Civil Procedure) Rules 2009.

Justice Ifeoma Jombo-Ofo is set for the Court of Appeal, with the National Judicial council (NJC) agreeing to allow her take the oath.
Chief Justice of Nigeria (CJN) Mariam Aloma-Mukhtar declined to swear her in alongside 11 justices approved by President Goodluck Jonathan for elevation to the Court of Appeal.
The CJN did not swear her in because she is not an indigene of Abia State that recommended her elevation, even though her husband is from Abia and she has been serving there for many years.
Rising from an emergency meeting yesterday in Abuja, the NJC unanimously agreed to swear her in as a Justice of the Court of Appeal.
A statement by, spokesman of the council, Mr. Soji Oye, said the CJN deserved commendation and not vilification, for exercising sufficient caution, diligence and maturity in the way she handled matter.
It noted the controversy the issue had generated.
The NJC recalled that the CJN, in a November 5 letter to President Goodluck Jonathan, informed him of the facts surrounding the elevation of Justice Jombo-Ofo.
It also recalled that the Senate, without any consultation with the CJN, passed a Resolution on November 7 to the following effect:-
(a) That the Senate urged the Chief Justice of Nigeria to swear in Honourable Justice Ifeoma Jombo-Ofo as a Justice of the Court of Appeal; and
(b) That the Senate urged all Government Employing Agencies to note in terms of employing a married woman, shall lay claims to her state of origin and that of her husband in relation to the Federal Character Regulations.
The statement notes that” the binding principles and formulae for the Distribution of all Cadres of Posts (S.I.23 of 1997) provides in Part II, Section 2, that “A married woman shall continue to lay claim to her State of origin for the purpose of implementation of the Federal Character formulae at the National level”.
“That the Honourable Chief Justice of Nigeria and Chairman of the National Judicial Council had by a letter dated 5th November, 2012, duly written to His Excellency, Dr. Goodluck Ebele Jonathan, GCFR, President of the Federal Republic of Nigeria, to inform His Excellency that the matter of Honourable Justice Ifeoma Jombo-Ofo and the fact that she was not sworn in on the 5th of November, 2012 would be tabled before the National Judicial Council.
“That the Federal Judicial Service Commission and the National Judicial Council, being Federal Executive Bodies established in pursuance of Section 153(1(i) of the 1999 Constitution of the Federal Republic of Nigeria, are bound and obliged to observe and obey the provisions of the Constitutional Law of the Federal Republic of Nigeria, including the Federal Character Commission Act.
“ That the Senate of the Federal Republic of Nigeria is also bound and obliged to observe and obey the stipulations of the Constitution and Laws of the Federal Republic of Nigeria, including the Federal Character Commission Act; without prejudice to the undisputed power of the National Assembly to amend and\or repeal the said Act.
“That the Honourable Chief Justice of Nigeria and Chairman of the National Judicial Council must be commended for exercising sufficient caution, diligence and maturity in the matter, especially in the light of the documents, materials and other information available to her, and for taking the decision to put on hold the swearing-in of Honourable justice Ifeoma Jombo-Ofo as a Justice of the Court of Appeal, to await a Meeting of the National Judicial Council to review the matter in all its ramifications.
“And after full and dispassionate deliberations on the matter, the council unanimously decided that Honourable Justice Ifeoma Jombo-Ofo be sworn-in as a Justice of the Court of Appeal”.
Called to the Nigerian Bar in 1979, Justice Jombo-Ofo was appointed a High Court judge on November 4, 1998.

Edo Poll: Witnesses Allege ACN Shared Money to Influence Voters

The Edo State Governorship Election Petitions Tribunal sitting in Benin City Wednesday resumed hearing on the cross-examination of principal witnesses to the alleged electoral malpractices brought before it by the candidate of the Peoples Democratic Party (PDP) in the July 14 poll, Major General Charles Airhiavbere, against Governor Adams Oshiomhole of the Action Congress of Nigeria (ACN), who was declared winner by the Independent National Electoral Commission (INEC).
During the hearing, five witnesses had appeared before the tribunal. First among them was United States of America certified intelligence analyst and a politician, Mrs. Omololu Ogbeni, as PW 5.
Appearing before the tribunal also, is a farmer from Orhionmwon Local Government Area of state, Mr. Peter Osawaru, Mr. Philip Osawaru, Deaconess Marina Osaghae, and Mrs. Jennifer Ologbosere.
Testifying at the tribunal yesterday, Ogbeni alleged that PDP members at Agbado Primary School, one of the voting centres on the election day were chased out, harassed and threatened by the ACN.
Particularly, Osaghae alleged that the ACN in her unit gave out money to voters in order to win their votes.
Besides, she alleged that “ACN members represented Labour Party, Congress for Progressive Change (CPC) and other parties as agents. If you see them that day you would think they were representing those parties because of their tags whereas they were for the interest of ACN.”
On her part, Ologbosere alleged that ACN members shared money, La-casera, gala sausage to influence voters at the unit 12.
“At the Oza Primary School, where Edo State House of Assembly Speaker, Hon. Uyi Igbe also voted was marred by electoral malpractices”, she stated, alleging further that the speaker brought in N500 and N100 notes in lump sum to the election ground and distributed same to voters.
These testimonies were given before the three-member panel of the tribunal led Justice Mu’azu Pindinga, before the tribunal adjourned sitting,” she said.

Opinion: Only God can judge pastors, but man can testify

A pastor should receive a gift jet when every other member of his Christian community receives one.
Nigeria, thank God, is a very religious country. Very, very religious indeed such that when anyone attempts to criticize a religious leader of owning a private jet, they rise in their millions to defend such a leader. Even when such person eventually manages to appeal to their rationality they prove their staunch devoutness and deep piety by having the last say: “We are not to judge” or, “Touch not my anointed and do my prophet no harm.”
Well, I wouldn’t go near enough to touch one not to talk of doing any ‘anointed’ any harm. Plus the bible forbids me to judge any human, talk more an anointed. But the bible doesn’t say I shouldn’t testify.
If anything it encourages me to. So, while I won’t judge anybody, I sure will testify. Recently, a pastor in Imo state was accused of adultery. Another in Osun was accused of fornication. What am I saying? Many pastors all over the country have been accused of, and indeed have been found guilty of such immoral and condemnable behaviours. Our communities are rife with such occurrences. I wonder why Christians don’t rise to the defence of such pastors, or are they not anointed enough? That begs the question, how do we even determine who is anointed and who is not? I’ve asked this question severally but none of the said faithful could give a satisfactory response.
Some say hence such a person mounts a pulpit and preaches the bible then he’s anointed. Yet we acknowledge that we’re living in the end time and Christ himself said many false prophets will rise and preach and perform miracles in his name. Are these false prophets also anointed? If no, how do we tell the anointed from the false? Is it by their preaching (they all preach the same Bible anyway) or by their practices?
A pastor owning a jet, or in recent terms receiving a gift jet from a congregation is not a bad thing, not legally at least. Since I’ve said I won’t be judging, I would leave God to determine if it’s a sin or not. But morally and psychologically, considering the socio-economic situation the country has been flung into, considering the multitude of impoverished and indigent people around us and even among our congregations, and considering especially how the early Christians lived which should be a model for any Bible believer and any Bible believing congregation (the Bible said whatever they had they shared equally), a pastor should own a jet only if the other members of his Christian community own one as well.
A pastor should receive a gift jet when every other member of his Christian community receives one. Okay, let’s assume that is unattainable, but what happened to the humans out there who only live expecting death? The people out there who have great dreams and aspirations that could move the country forward but no motivation? People out there who couldn’t send a child to school? The numerous impoverished souls dying out there whom a jet’s worth of philanthropy could have saved?
Indeed, no matter what a pastor or anyone else for that matter does, we would always have the poor and the dying with us, but I think it should matter to us that one less person doesn’t die for nothing. That one less person doesn’t get to attain his aspiration. That our actions could either save a dying soul or leave such to their fate, a fate a jet’s worth of aid could have altered for the better. Thus I ask, which is humanely ‘wronger’; an anointed who sleeps with a woman who is not his wife or one whose action could lead, even though unknowingly to the perishing of a soul?
Again let me ask, prior to owning or receiving a gift jet, doesn’t the big pastor fly overseas for ministry or any other businesses he has? Doesn’t he fly in comfort; in first class of the best airlines? Hasn’t his ministry grown all too well during those times? Why then does he suddenly need a private jet? What extra spiritual benefit would the acquisition of a private jet add to him, to his congregation, his country and to the human race? Would it attract new members, would it keep old ones? Would it ensure the salvation of anyone? What would be the fate impact of the acquisition of luxury?
Yes, yes, the Dangote’s, Adenuga’s, business men and politicians have private jets why not ask them why they acquired theirs. It’s simple. Our business men and politicians are not pastors or religious leaders. They are of this world, our pastors shouldn’t be of the world, should they? Our politicians most of whom are business moguls are corrupt, the last thing anyone wants is our pastors and religious leaders being like them; living extravagant lives.
Neither Christ nor Mohammed nor Buddha was like the politicians and business men of their times. As a matter of fact, they were all rich but all at some point left their riches and glory and became lowly individuals. Is the lesson in that so hard to comprehend? There is a fine line between ‘Bible believing’ and ‘Bible preaching’ church even though we fail to see it. If what we claim to preach and believe does not reflect in our life and the things we do then we better start asking if we really believe what we hear being preached because they are both entirely different things. You can’t say you believe if that belief doesn’t reflect in your actions.
The problem with Nigeria is leadership; political and especially religious leadership. It’s my opinion that if we indeed have strong and effective religious leadership, the political leadership would be forced into sanity. In a country as ours where political leadership has failed woefully and is still failing, I think the strongest and most potent institution to right the situation is the religious institution. But when even that fails then the future is indeed bleak and the country’s problems just began. Ever wondered why we are among the most religious countries on earth yet with some of the highest poverty rates? Yes, it’s because of bad political leadership, a situation which religious leadership with all the strong sentiments they have among the population has done nothing about. The time has come for us to demand as much from religious leaders as we do from their political counterparts.

15-year-old Nigerian girl wins Spellbound Africa competition


After correctly spelling 37 words live on-stage, 15 year-old Ibukun Omoyeni of Prince of Glory College, Lagos, spelt the word myxomatosis to win the 2012 edition of Spellbound Africa recently held at Abuja. He beat children from 13 other states and the FCT to successfully defend the Title won by Gbemileke Oyefeso also of Lagos State in 2011.
In second position was 12 year old Hauwa’u Lawal of Jigawa State Academy For the Gifted and Talented, Bamaina. She spelt 37 words correctly. Adaeze Williams of Divine Mercy Secondary School, Abuja came third, while Olivia Okechukwu of Community Senior Secondary school Oyingbo, Rivers State, came fourth.
The children studied 3,000 english words for 3 months from which words were chosen for them to spell. Words like phantasmagoria, arteriosclerosis, neuroinformatics, discombobulated, higgledy-piggledy etc were spelt.
At this event, the Guest of Honour, the Governor of Jigawa State, represented by Alhaji Isa Audu, received the annual SUPER-DAD AWARD from organisers of the competition Ski-Hi Entertainment for his contribution to education in Jigawa State. He restated his commitment to education as a means of preparing the young generation for the challenges ahead of them. Aero Contractors also received the Most Supportive & Reliable Brand Award 2012 for consistently supporting this project.
Spellbound Africa is an annual spelling competition for children studying in the English-speaking African countries. It is for children between 10 and 15 years old and has run for four years now.
The Chief Executive of Ski-Hi Entertainment, Mr. Ifeanyi Ogbu, called on corporate brands and media houses to consider sponsoring academic events like this if Nigeria is to have any hope of prosperity in future. He also, pointed out that football, music or acting is not the only war to fame and fortune; but that everyone should cooperate to present academic excellence as a sustainable route to the top.
15 States of the federation as well as Ghana and Sierra Leone participated in the 2012 edition of Spellbound Africa.

Cristiano Ronaldo donates €1.5mn to children in Gaza

Real Madrid iconic forward Cristiano Ronaldo has donated €1.5 million to Palestinian children in Gaza, the Arabic version of the club’s Classico network reports.
The star forward gave his Golden Boot which he earned in 2011 to the Real Madrid foundation. The Spanish giants in their turn sold it at auction and will now donate the funds to schools in Gaza
According to various reports, the Real Madrid Foundation has helped to build 167 schools in 66 countries.
It’s not the first time Ronaldo has given to charity. Last year he sold most of his sports shoes at a Real Madrid Foundation auction which was also dedicated to raising funds for schools in Gaza.
Ronaldo became the most expensive footballer in history after moving from Manchester United to Real Madrid in a transfer worth €93.9 million. In addition, his contract with Real Madrid, in which he is paid €12 million per year, makes him one of the highest-paid footballers in the world.
