Petition to IGP Urges Reopening of Gani Fawehinmi Criminal Allegations Case Against Bola Tinubu; Lagos State Govt Declines FOI Request To Disclose Alpha Beta Payments

A medical doctor, Adegbola Dominic of Santa Maria Hospital in Lagos, has requested the Inspector General of Police (IGP) to constitute a unit of the force to re-open, commence, take over or conclude the 1999 into the 1999criminal allegations against Chief Bola Ahmed Tinubu, with the objective of prosecuting the former governor if need be.
In a letter dated November 1, 2012, Dr. Dominic, an indigene of Lagos State, recalled that in September 1999 when Mr. Bola Ahmed Tinubu was the Governor of Lagos State, the late Chief Gani Fawehinmi lodged criminal complaints were made against him, seeking to investigate the criminal allegations of falsification of statement/declaration and documents/certificates.
“You would also recall that The Supreme Court held that although you could investigate the Governor who then enjoyed immunity under Section 308 of the Constitution, 1999, you could not prosecute him in view of the express Constitutional Governor’s Immunity provisions of Section 308 – That `no Civil or Criminal proceedings shall be instituted or continued against a person to whom this Section applies during his period of Office’.”
 The letter says that the Action Congress of Nigeria chief  left office as Governor in 2007, losing the constitutional immunity in the process, but that those serious criminal allegations, which are more serious than those for which Salisu Buhari, a former Speaker of the House of Representatives was investing, have not been investigated.
Indeed, said the complaint, “since the demise of Chief Gani Fawehinmi, your office seems to have fallen asleep over the matter,” over serious criminal allegations that should not to be swept under the carpet.
He said his request is based mainly on the duties responsibilities and obligations of the IGP as provided for under the Constitution and Section 4 of the Police Act Cap 359, 1990 Laws of the Federation which says:
“The police shall be employed for the prevention and detection of crime, the apprehension of offenders, the preservation of law and order, the protection of life and property and the due enforcement of all laws and regulations with which they are directly charged, and shall perform such military duties within or without Nigeria as may be required by them or under the authority of this or any other Act”.
Further pointing out that the IGP would be in violation of the specific provisions of the Constitution and the Police Act if he fails, refuses or neglects to grant his request within 14 days, Dr. Dominic warned that he would initiate legal proceedings against him.
Copies of the letter were sent to the President, in his capacity as the Chairman of the Nigeria Police Council, and the Minister for Police Affairs.
 In an earlier petition, dated October 24, 2012, Dr. Dominic sought from the Commissioner for Finance of Lagos State, under the Freedom of Information Act (2011), detailed information about the contractual relationship between the Government of Lagos State and Alpha Beta Consulting Ltd since 1999, under which the latter has collected taxes on behalf of the government for a commission of 15 per cent per month since that time.
It noted that the Government of Lagos State now boasts internally-generated revenues (IGR) of about N40 billion every month, “translating into a commission of N6 Billion due to and being paid to the Company every month, which sum I consider unfavourable and outrageous to me as a tax payer and Citizen of Lagos State,” the complaint said.
Under that arrangement, Alpha Beta Consulting, which is owned by former Governor Tinubu, will in 2012 alone corner about N72 billion of the revenues of the internally-generated tax revenue of Lagos State.
It was copied to the Board of Lagos State Internal Revenue Service, The Auditor-General, the Special Adviser, Taxation & Revenue and the Attorney-General of Lagos State.
In a response dated November 5, 2012, OlanrewajuAkinsola, Special Senior Assistant to the Governor (Justice Sector Reforms) in the Office of the Attorney-General and Commissioner for Justice, rejected the application, saying that the FOI is only federal legislation that is not binding on the States.

Famously known as Adams Picolo, Osuagwu decided to add colour to his wedding by riding in a truck down to the venue of the wedding.
Earlier, the couple arrived the St. Paul Anglican Cathedral, located at Diobu Garrison Junction, Aba Road Port Harcourt in a separate Black G-Class Mercedes and Wine colour Range Rover.
The star-studded nuptial took a hilarious dimension after the couple exchanged marital vows as they both mounted the truck through a ladder alongside Nollywood actor Francis Duru and his wife, Adokiye who acted as the Best man and chief bridesmaid respectively.
The city went agog as the ‘wedding train’ led by the brigade band and a Rapid Response Squad (RRS) police team, navigated through the streets of Port Harcourt.
After the exchange of vows, Osuagwu, an ex member of the Boys Brigade, was honoured by the brigade corps in a display match during which he was awarded a badge of honour.
The well-attended event was witnessed by Nollywood A-list actors such as, John Okafor, popularly known as Mr Ibu, Nollywood twins Chinedu Ikedieze and Osita Iheme of the Aki and Pawpaw fame, former President of Actors’ Guild of Nigeria, (AGN) Ejike Asiegbu and music star, Muma Gee. Tribunal grants ACN’s application for inspection of Ondo election materials

 The Governorship Election Tribunal sitting in Akure, Ondo State, Thursday, granted the application of the Action Congress of Nigeria, ACN, and its candidate, Oluwarotimi Akeredolu, to inspect the election materials used by Independent National Electoral Commission, INEC, in the October 20 election held in the State.
The application, filed and argued by ACN’s lawyers, was granted as prayed.
The Justice A. Kaka’n led Tribunal directed INEC to make all documents used for the election available for the inspection of the Petitioners at its Alagbaka Office, Akure as from 10 a.m. every day.
The Tribunal urged counsels to maintain decorum and peace during the inspection.
The Tribunal Chairman also ordered the Police to provide security for lawyers during the said inspection.
Similarly the Tribunal granted the application of Governor, Segun Mimiko of Labour Party, LP, to inspect the INEC materials.
The election tribunal ruled that the ACN and Mr. Mimiko’s inspection at the INEC office shall run concurrently and the absence of any of the parties will not bar the other from continuing with the inspection.
The Tribunal directed INEC to allow the petitioners and 1st Respondent to inspect, make copies, certify all election materials and scan by electronic process the used and unused ballot papers.
The Tribunal overruled Mr. Mimiko’s counsel, Olumide Ayeni, objections to some of the document to be inspected by the ACN.
Mr. Ayeni claimed that some of the document itemized by the Petitioners for inspection was not used for the October 20 Governorship Election.
But, Justice Kaka’n ruled that the objection is premature at this stage of inspection and should be reserved till the trial stage of the petition.

Nigerian Finance Minister Ngozi Okonjo-Iweala's Statement Regarding Release Of Her Kidnapped Mother

Nigeria's finance minister, Ngozi Okonjo-Iweala, released a statement today shortly after the release of her mother from kidnappers in Delta state. The statement below did not offer much detail about Professor Kamene Okonjo release from kidnappers 5 days after the 82-year woman was kidnapped from her home in the state.
However, the statement praised President Goodluck Jonathan, security agencies and some state governors for their support throughout her ordeal. Family sources told SaharaReporters that the minister refused to negotiate directly with the kidnappers throughout the saga.
Security sources earlier told SaharaReporters that Mrs. okonjo had been released from kidnappers but details of her release from kidnappers remains sketchy.

I can confirm that Professor Mrs Kamene Okonjo, wife of the Obi of Ogwashi-Uku, Professor Chukuka Okonjo and mother of the Coordinating Minister for the Economy/Minister of Finance, Dr Ngozi Okonjo-Iweala was released this morning, five days after her abduction.
The Okonjo Family is full of thanks to the Almighty for this happy development. Police Give Conflicting Details Regarding Okonjo-Iweala's Mother's Escape From Kidnappers

The official story given by police to explain the release of kidnapped Prof. Kamene Okonjo, mother of Minister Ngozi Okonjo-Iweala, is raising doubt about the real circumstances surrounding her escape.
At a press conference, Delta State Commissioner of Police, Ikechukwu Aduba, said the Queen Mother was freed by her abductors after five days in confinement and taken home by motorcycle from Kwale, 50 kilometers away. The young man who dropped off Mrs. Okonjo has been arrested and is being questioned, police said.
What remains confusing is the mode of transportation of Professor Okonjo on a motorbike from the scene of freedom to her home if actually the police stormed the kidnappers hideout and rescued her as being claimed.

With the case "resolved," it remains unclear whether those arrested in recent days in connection with the kidnapping would be released or charged.

The Queen Mother of Ogwashi-Uku was kidnapped last Sunday at aboaut 1:47 p.m. by 10 armed kidnappers at her husband’s palace.

Unofficial sources told our reporter that the Queen Mother managed to free herself unassisted, but an updated police version of the story alleges that police stormed the kidnappers’ den in Asaba, the state capital, where they killed one suspect, Nwaze Nwosa aka Bolaji, arrested another gang member and shot four members of the gang who escaped with bullet wounds.

It is unclear what role the storming of a location in Asaba had to do with the kidnap victim regaining her freedom in Kwale. Also unknown is whether a ransom was paid to facilitate her release.
Earlier, the Police Command blamed "insiders" for orchestrating the Queen Mother’s abduction, and they unmasked the identity of 25 suspected kidnappers, armed robbers and pipeline vandals that have been terrorizing the oil rich state.

Briefing journalists at the command headquarters in Asaba today, CP Aduba said the sensitive nature of Queen Mother Okonjo’s kidnap made the command beam its searchlight on any obvious errors or lapses either on the part of the palace guards or the Divisional Police Headquarters in Ogwashi-Uku. He said the release of the victim involved the combined efforts of the crack team of policemen deployed by the Inspector-General of Police, Muhammed Abubakar, and the proactiveness of men of the Special Anti-Crime Squad (SARS).
According to him, “the Delta State Police supported by a crack team from IGP’s Special Task Force on Terrorism, Abuja, consciously and professionally with due caution collated intelligence on the activities of the hoodlums and struck their hideouts in Asaba.” He said the manhunt for the fleeing members of the gang was on and that the command would not rest until they were arrested.
He displayed the items recovered from their hideouts to include an ash-coloured Golf 3 car with registration number DELTA ASB 697 AA, which he said had been used to transport the Queen Mother out of the palace; and a white Toyota bus, labeled God’s Delight Church International, with registration number ANAMBRA KPP 64 XA.
A Police source in the state told SaharaReporters that the dead leader of the kidnap gang had been on the most wanted list for his alleged involvement in a series of kidnapping and violent crimes in the state. He also stated that the Delta state police command once arrested him and charged him with various crimes, but he was released without trial and kidnappings continue unabated in the state.

Her husband, Obi Chukwuka Okonjo Agbogidi, a retired professor of economics, is the traditional ruler of the Ogwashi-Uku kingdom in Delta State.

“There will soon be no difference between living and dying in Nigeria” – David West


A former Minister of Petroleum and frontline elder statesman, Professor Tam David-West has said that from the look of things, Nigeria may find it hard to succeed.
The former minister said this while delivering the 13th annual distinguished guest lecture entitled: “The Social Pyramid and Good Governance” organised by a group known as The Forum in the University College Hospital (UCH), Ibadan, on Tuesday.
According to him, “Like Jeremy Bentham says, the happiness of the people in a society is the end of governance. But what do we have in Nigeria. The gap between the rich and the poor keeps expanding.
“If this gap is not narrowed, a time will soon come when the suffering masses will see no difference between living and dying and will take up arms against the state. And when this happens, Abuja cannot stand.
“I have argued with documented evidence that there is nothing like fuel subsidy and so they can’t remove what does not exist. Petrol should sell for N40 in Nigeria. Although officially it is N97, marketers sell petrol for between N110 and N120 and government closes its eyes to this illegality.
“The Ribadu panel has shown how the country lost billions of naira to swindlers under non-existing subsidy. A senator earns N500,000 in a day and N15.18 million in a month, which can employ President Barrack Obama four times,” David-West said.
“From the way the country is being run, Nigeria has no right to succeed. We are called the giant in Africa and we are truly giant in many negative things. This country can’t survive because it is anti-poor and consequently anti-God. There is also an elastic limit to people’s suffering,” he said.
The frontline ijaw leaders observed that the only way the political class could avoid a revolution in the country was to provide good governance through policies that would reduce the gap between the haves and the have-nots.
He voiced his opposition to the clamour for a Sovereign National Conference (SNC) on the grounds that the resolution reached at such conference about the structure of governance of the country might not be in the interest of the masses.
Notable Nigerians at the lecture included Professor O.O Akinkugbe; Dr Kayode Obembe; the Provost, College of Medicine of the University of Ibadan, Professor O.O Akinyinka; and a representative of the university’s vice-chancellor.

Can Oshiomhole prove his certificates are not fake?


Oshiomhole-and-AirhiavbereThe resounding victory of the Comrade Governor, Adams Oshiomhole recorded over the combined cult of fixers, godfathers and godsons who for ten harrowing years withheld the dividend of democracy from the Edo people for the grand satiation of their ancient greed and rapacious tendencies have left a bitter pill in the mouth of the PDP big wigs as they watched retired Major General Charles Airhiavbere’s high hopes for the July 14, 2012 elections crumble like a pack of cards.
He failed to win in his polling unit where he voted, losing by a landslide across the 18 local government areas of the state, to prove that when the electorate are allowed to make the best possible choice on who governs, Nigerians and indeed the Edo people, can make a difference with democracy.
In his first tenure in 2008, Comrade Adams Oshiomhole on assumption of office, after a prolonged court battle to reclaim his stolen mandate from Prof. Oserheimen Osunbor, was in a hurry to perform and demonstrated to Edo people that the change they crave is not impossible as the PDP made it seem. Across the State, schools were refurbished and built, potable water provided for areas without water for 25 years due to rocky and low level of water table, road construction and reconstruction, the agricultural sector has been repositioned, internal revenue leapfrogged from a paltry 200million to about 2billion naira monthly.
In the health sector, hospitals were built and renovated. For the first time in almost a decade, Edo was truly working as it became a massive construction site. His unprecedented achievements earned him accolades and awards from within and outside the state. His impressive first term scorecard resulted in a clamour from royal fathers, chiefs, professionals, clerics, civil societies, organisations, groups and the Edo man on the streets to seek a second term in office. As the elections drew near, the Edo people were not just rooting for him but prepared to defend their votes to ensure that the Comrade Governor, as he is now fondly called, is given an opportunity to consolidate on the giant strides in his first term. The Oba of Benin, Oba Erediauwa, CFR, while receiving ACN leaders to his palace prior to the July 2012 elections summed up the wishes of well-meaning people of Edo state this way “we are all praying for Oshiomhole to be re-elected in 2012. I and my chiefs are also hoping that he comes back and complete unfinished projects.”
Despite the elections widely considered as free and fair, the PDP went ahead to contest the outcome of the poll at the State Election Petition Tribunal. After consultation with the leadership of the party, within and outside the state, they made a U-turn and withdrew their petition barely three days after it was filed. The state chairman of the party, Chief Dan Orbih in a press statement titled Let God Be The Judge remarked “we have resolved not to file election charges at the tribunal in the interest of the state”.
However, they still maintained that the results where manipulated to favour the incumbent. Apparently the PDP weighed its options and decided not to proceed with its case, thinking it would turn out to be an exercise in futility.
General Airhiavbere (rtd) would not have any of this as he proceeded to file an application challenging Oshiomhole’s re-election on the basis of certificate forgery and perjury. He alleged that the elementary school Oshiomhole claimed to have attended was not in existence at that time, and that he also tendered fake certificate on oath to INEC from Blessed Martins Modern Secondary School from which he dropped out. Going by constitutional provisions, this disqualifies him from contesting the election.
Against this background, General Charles Airhiavbere told the Tribunal that all certificates presented to INEC by Comrade Adams Oshiomhole to contest the July 2012 election were mere documents.
Indeed, a closer look at Governor Oshiomhole’s credentials showed that though he claimed to have attended Iyamoh Primary School, Iyamoh, in the then Midwest state from 1957-1962. His claim is however, contrary to investigation at the Edo State Ministry of Education which revealed that Iyamoh Primary School was founded in 1963, a year after the governor said he graduated from it. His name is said not to be in the class register nor among the graduated class of the Blessed Martins Secondary Modern School he claimed to have graduated from in 1965. If he was born in 1953 and graduated from a secondary school in 1965, as declared on oath, could it be correct that he complete secondary school at the age of 12?
Curiously, the name on Oshiomhole’s primary and secondary school certificates simply bears Adams Aliu, and his Ahmadu Bello University Adult Education certificate submitted to INEC, bears Adams O. Aliyu, while subsequent certificates bear his current name Adams Aliyu Oshiomhole.
This disconnect in his names was made evident when the comrade governor in a handwritten affidavit he personally deposed to INEC stated that he had no previous names other than Adams Aliyu Oshiomhole. The discrepancy in Oshiomhole’s stated dates, names and schools belie the veracity of his claim and may be considered as perjury on oath. The PDP’s candidate argues that in line with the provisions of the constitution, the governor was not eligible to stand as a candidate in the election.
After Oshiomhole’s claim to secondary education, he obtained an adult education certificate from Ahmadu Bello University before proceeding to Ruskin College, Oxford, an educational institution that specialises in providing education opportunities for adults with few or no formal qualifications, where he obtained a diploma in Economics and Industrial Relations. He is also an Alumnus of the prestigious National Institute for Policy and Strategic Studies, Kuru.
The 1999 constitution stipulates, “a person shall be qualified for election to the office of Governor of a State if
(a) He is a citizen of Nigeria by birth;
(b) He has attained the age of thirty-five years;
(c) He is a member of a political party and is sponsored by that political party; and
(d) He has been educated up to at least School Certificate level or its equivalent.”
Sub section (d) above is the relevant section Airhiavbere is holding unto, asking the election tribunal to quash Oshiomhole’s election.
Pertinent to note, on Sept. 27, Justice Suleman Ambrusa of the election petition tribunal , struck out several paragraphs of General Airhiavbere’s petition, on the basis that it was a pre-election issue, which only the regular court had jurisdiction to handle.
On Arhiavbere’s appeal, the court of appeal ruled in his favour that the tribunal erred in law to have disqualified itself from entertaining the reliefs that bothered on Oshiomhole’s educational qualification to contest the governorship election and therefore restored its pleadings and ordered that the Acting President of the Court of Appeal should re-constitute a new tribunal to revisit the petition filed by the retired Major General.
 A more objective angle to the tribunal proceedings can be a simple clarification of the Nigerian constitution as it applies to qualifications when running for public office. Its not unusual in Nigeria to have cases of certificate forgery post election. As it is with other court cases, evidence is key and certificate forgery is a very difficult one to prove.
Senator Yisa Braimoh had his suit of certificate forgery against Senator Domingo Obende representing Edo North Senatorial district dismissed by a Federal High Court in Abuja. Similarly, Benue State Governor, Gabriel Suswan won a case on educational qualification instituted against him at the Federal High Court Abuja by a chieftain of the PDP, Terver Kakih. On the flipside, former Speaker of Federal House of Representative, Alhaji Salisu Buhari was disgraced out of office for awarding himself a fake certificate he claimed to have obtained from the University of Toronto. Today, there abound numerous cases of certificate forgery in the country.
Issues of certificate forgery are not uncommon in other political climes. President Barack Obama, during the run-up to his re-election into the White House had to prove his place of birth was Hawaii by publishing his original birth certificate to effectively silence his critics.
Undeniably, Governor Oshiomhole has lifted Edo State from the doldrum and inept leadership of the heisty hands of former PDP Governors, putting the state on the path to economic recovery and sustainable development. The election petition tribunal sitting is a distraction.
Though Oshiomhole has tried to brave the odds, sources close to the governor say he has been shaken by the discovery of discrepancies in his academic qualification. Earlier, Oshiomhole in his response to the petition filed against him at the tribunal said he considered it frivolous. These allegations have however gathered momentum and now seem capable of truncating his giant strides and unwavering commitment to the upliftment of Edo state and its people.
The big questions remain; can Governor Adams Oshiomhole prove his certificates? Can he weather the storm?
Only time will tell.
