New Man Joins Legal Tussle To Get Ibori’s $15million Bribe Money

More drama played out on Monday before a Federal High Court sitting in Abuja as the court presided by Justice Gabriel Kolawole adjourned till Friday, 23rd November, to rule on an application brought by a Lagos state based technician, Mr. Olalekan Bayode, who wants the court to join him as an intervener in the controversial $15 million
bribe money allegedly given by former Delta state governor, Mr. James Ibori, to former chairman of Economic and Financial Crimes Commission, EFCC, Mallam Nuhu Ribadu.
The anti-graft agency had last July approached the court with an application seeking the forfeiture of the alleged bribe money, which had been in the custody of the Central Bank of Nigeria, to the Federal Government.
No sooner had the court granted a temporary forfeiture of the money to the Nigerian government, with an order for any interested party to come forth and show cause why the money should not be finally forfeited than persons of very questionable character surreptitiously appeared to lay claim to the slush fund.
An unknown, self acclaimed oil magnate, Mr. Chibuike Achigbu, emerged from no where and stirred the hornet nest when he caused a team of ten senior lawyers, including senior advocates of Nigeria, to file an affidavit wherein he claimed ownership of the money.
He that he raised the money and gave it to Senator Andy Uba, who was then the Domestic Aide to former President Olusegun Obasanjo, for the purpose of financing the Peoples Democratic Party during the 2007 general elections.
In the affidavit, Achigbu stated that he first sought legal advice on whether he could raise money to support the PDP and its candidates throughout the federation for the purpose of winning the 2007 general elections.
According to the him, by April 2007 when the election had drawn near, he had raised money in excess of N2 billion after which he realized that such donations could only be made and accepted through a financial institution.
He further stated that in order to legitimately apply the funds, that he approached Andy Uba to contact relevant agencies of government to investigate and certify that the funds were raised honestly and in good faith with a view to donating same to finance PDP.
This attempt drew criticisms from the public forcing the “oil magnate” to quickly withdraw his odious application.
As soon as Achigbu withdrew his application, a lawyer, Mr. Timipa Okponipere, who claimed to be representing the Delta state government also applied to be joined in the matter. He requested that the money be returned to Delta state and alleged that the money was removed from the treasury of the state and rightly belonged to the people of the state.
Delta state government, which until then had not come forth to lay claim to the money was quick to disown the lawyer with the state’s Attorney General, Mr. Ajuya, a senior advocate of Nigeria, categorically stating that the state government did not brief the lawyer to represent it in the matter.
With that, the lawyer disappeared from the scene leaving the state to take its destiny in its hand in the quest to return the money to the state.
Just as arguments were to be taken between the anti graft agency and Delta state government over who owns the money, Mr. Olalekan Bayode who claims to be a fridge and air conditioners technician at Alagbado, a suburb in Lagos state, also brought an application through a United Kingdom based Nigerian legal practitioner, Mr. John Olufemi Aina, asking that he be appointed by the court as an intervener to manage the fund for the benefit of Nigerians and averred that he did not want the fund to go the way of previously recovered proceeds of crime which cannot be accounted for by the recipients.
Both the anti graft agency represented by Mr. Rotimi Jacobs, a senior advocate of Nigeri, and Delta state government opposed Mr. Bayode’s application.
Mr. Ajuya, in his opposition argued that Mr. Bayode has not shown any reason for him to be joined in the matter. He contended that the court’s order made in July was for any interested party to come and lay claims to the money but that Mr. Bayode’s application was an offer to be allowed to manage the $15 million on behalf of Nigerians. He posited that the management of the money or who will manage it efficiently are not the business of the court but the ownership. He categorically stated that the money belongs to Delta state and that the state can manage it efficiently and therefore urged the court to refuse the application.
On his part, Mr. Jacobs pointed out that for Mr. Bayode to be joined as an intervener, that he needs to show that he is an interested party to the subject matter of the case and has a legal right that is being threatened by the case as well as show that the court cannot effectively decide the matter without him.
He contended that the applicant had not show any interest in the matter other than to say the he is a Nigerian citizen and beneficial owner of the unclaimed money.
He further reminded the court that its order was for any one who has interest to come forward under section 17 of the Advance Fee Fraud Act, before the court makes an order of final forfeiture of the money.
“The person envisaged by that section is the genuine owner of the money in question and not a busy body such as Mr. Olalekan Bayode who claims to repair Air conditioners and Fridges at Alogbado in Lagos state. He is not asking for the money to be forfeited to him as the owner and this clearly makes him a stranger in the matter” he added.
He subsequently urged the court to refuse the application.

He was also one of the brains behind the Advertising Practitioners Council of Niger (APCON). He served on the boards and panels of several international and domestic advertising bodies.

Borno Government to build 750 houses for flood victims


Borno state government is to build 750 two bedroom and three bedroom housing units for the flood victims in Damasak, Duji and Tala Ngam and Gashigar villages of Mobar local governments of the state.
Governor Shettima who disclosed this to newsmen in Damasak, the Headquarters of Mabbar local government yesterday while laying the foundation of the 750 housing unit said it was the responsibility of the government to come to the aid of its citizens in times of need.
He said “the construction of 750 two and three bedroom flats is to provide shelter to the victims of the flood in Mobar local government and this is going be done within two to three months. I came here to personally take charge of the projects and I am going spend 3 to 5 days.
The Governor said that already the state government has provided food items, mattresses drugs, sanitary materials, and mosquito nets among other house hold materials to all the camps in the local government.
He stated that government would provide food to those whose farms were destroyed by the flood, stressing that some compensation will also be paid to those who lost their cash crops in the disaster.
Also speaking, the state commissioner of health, Dr. Salma Anas Kolo said that the state government has so far spent N15 million on the purchase of drugs, sanitary materials, mosquito nets and other materials in the four camps within the area.
She said immediately after the flood, medical team were deployed to the camps to provide health care needs in the camps and also forestall out break of any disease in the affected areas.
In her contribution, the state commissioner of Poverty alleviation and Youths Empowerment, Dr. Zainab Gimba said the ministry procured some hydro pump machines to train the youths in bricks making and also to use it to build houses for the victims in the state.
The commissioner stated that over 200 youths of the area have been trained in bricks making and are currently engaged in the molding of blocks that are now being used for the construction of houses to the flood victims.

Coincidence? Bola Tinubu named Egba Field Marshal as aide, Toyin Hamzat is assassinated in Ogun

Four gunmen yesterday shot and killed the former chairman of Ikeja Local Government, Toyin Hamzat.
Hamzat was said to have being waylaid by the gunmen around 9pm while dropping off a female companion in Sagamu, Ogun State.
Reports say the former chairman and the lady were reported to have been returning from a party when the unfortunate incident occurred.
The spokesman for the Ogun State Police Command, Muyiwa Adejobi, confirmed the incident. He disclosed that four suspects are already in police custody in connection to the assassination.
Meanwhile, the leader of the Action Congress of Nigeria (ACN), Bola Tinubu was earlier today conferred with one of the highest chieftaincy titles in Egbaland, the Aare-ago (Field Marshal of Egbaland) while his wife was installed Erelu Aare-ago.
Tinubu and his wife, Senator Oluremi Tinubu, were conferred the titles by the Alake of Egbaland, Oba Adedotun Aremu Gbadebo Okukenu IV.
The conferment of the chieftaincy titles was part of the activities marking the seventh coronation anniversary of Alake of Egbaland.
Inspite of the assassination of one of Tinubu’s political associates and former Ikeja Local Government Chairman, Toyin Hamzat, yesterday, the atmosphere was tension-free.

Lagos Makes 20 Global Cities List Alongside London, Paris


The efforts of Babatunde Raji Fashola of Lagos state to transform the city of Lagos to world class standards was recognized yesterday when the state was listed among the 20 global cities in the world. Cities that made the list would be committed to implementing innovation to help improve the lives of 121 million citizens.
The announcement, which was contained in a survey released by LLGA|Cities Pilot, noted that the programme was aimed at discovering and implementing the most promising solutions that meet pressing social and urban challenges.
A statement by the Commissioner for Science and Technology, Mr. Adebiyi Mabadeje, said over the coming 18 months, the initiative would evaluate about 1,000 submissions and implement real-life pilots in all partner cities to improve the quality of life in the cities.
Participating cities vary in population size from less than 100,000 to 21 million. The cities that made to top lists include, Aalborg, Barcelona, Boston, Christchurch, Eindhoven, Fukuoka DC, L’Hospitalet, Lagos, Lavasa, London, Mexico, Oulu, Paris, Rio de Janeiro, Rosario, San Francisco, Sant Cugat, Sheffield, Tacoma, Terrassa and York.
Challenges are presented by global cities – in partnership with Oracle, the UN Global Compact Cities Programme and The Climate Group – in areas such as mobility, economic development, social inclusion, health and wellbeing, urban management, lighting, energy, culture, future government and sustainable lifestyles.
“For year 2013 presentation, Lagos is seeking solutions to deliver content seamlessly in bandwidth-challenged environments to provide access to the social and economic benefits of Internet.
“In the past three editions, LLGA has attracted 1,519 entries from 70 countries. By providing systematic market intelligence to decision-makers in cities, the programme has proven to help cities discover innovative solutions that reach citizens three times faster with 80 per cent lower spending,” the statement added.
Speaking on the awards, Mabadeje, who is also the Chairman Lagos Innovation Advisory Council, said: “We are once again participating in this programme which seeks to promote innovation in service delivery by tapping into the more than seven billion potential innovators worldwide and hope LLGA will realise the solution that will best resolve our city’s challenge”.

Probe Obasanjo, IBB others, Clark tells Jonathan

Elder statesman and former Information Minister, Chief Edwin Kiagbodo Clark yesterday called
on President Goodluck Jonathan to summon the courage to prosecute past leaders including
Gen. Olusegun Obasanjo, Gen. Ibrahim Babangida and Gen. Abdulsalami Abubakar for
allegedly using their position as Nigerian heads of state to amass enormous wealth.
He spoke apparently in response to the alleged knocks on the administration of President
Goodluck Jonathan by former President Olusegun Obasanjo whom he accused of inciting
Nigerians against Jonathan "for reasons best known to him".
Speaking in a statement he released in Warri yesterday, Clark said that Obasanjo lacked the
uprightness or moral justification to criticize the President or his government.
He averred that Jonathan was today battling with the corruption-related problems created by
past Nigerian leaders like Obasanjo.
He said: "The problem of Nigeria is corruption by every living president or head of state in
Nigeria; and none of them, except two or three should therefore parade himself or see himself
as indispensable, let them be factual, and not to deceive fellow Nigerians.”
According to Clark;"Those ex-heads of state and presidents who contributed to the corruption in
Nigeria are the same former heads of state or presidents parading themselves as only former
heads of state, who could eradicate corruption or who believe that any head of state or
president who is ready to fight corruption must be ready to die.
This is hypocrisy and it must be taken as a call on the present administration to deal with
corruption cases no matter whose ox is gored, because in many parts of the world presidents
and former heads of state have been charged to court. Nobody should be seen as a sacred
cow.
"A situation whereby former heads of state who stole Nigerians' money and everybody knew
that they were corrupt are now buying the property of Nigeria, particularly in the power sector, is
condemnable; and, they should be held accountable. They should not be celebrated.
"It is sad that they are parading themselves as the only people who could deal with corruption
and they regard the present administration as being too weak to deal with it. Nigerians should
ask all former heads of state who "bidded" for power assets where they got the money. We
need to know their technical partners from abroad. Jonathan should probe where they got the
money.
"It is only in Nigeria that former heads of state are bidding to buy public property which they
corruptly mismanaged when they were in power. This does not happen in other parts of the
world. Such former heads of state should be facing trial for corruption or remain behind the
bars.
"Most heads of state and former presidents contributed to the corruption in the country. The
Halliburton scandal is fresh in our memories. It should not only be resuscitated to try all those
involved but the government must recover the money paid by Julius Berger under plea bargain.
All those involved should be tried no matter the position they occupied."
The elder statesman, however, urged Nigerians to question the above-named past leaders
about the sources of money being used by them to acquire public assets in the country.
He stressed that most past leaders in the country lacked moral and legal rights to talk or accuse
anybody of being corrupt.
"All Nigerian former heads of state and presidents, with the exception of about two or three, are
not supposed to be moving about as free citizens because of the level of their involvement in
corrupt practices while in office", he said.
Clark further challenged Jonathan to immediately probe the source of the money the ex-leaders
were using to buy up public assets as well as initiate the process for their trial.
He specifically lamented that Obasanjo who allegedly used his position as president of Nigeria
to amass questionable wealth was now portraying Jonathan as being incapable of performing
the duties of the office of the president.
He alleged that Obasanjo practically perpetuated and legalized corruption while presiding over
the affairs of the country.
He further claimed that Obasanjo remained one ex-leader Nigerians should wary of trusting.
"It agitates my mind when I read or hear of former heads of state or presidents claiming that
they are more positioned to fight corruption than any other one, particularly the present
administration. It angers one therefore to hear or read Obasanjo's claim as to how to curb
corruption in Nigeria when in fact he is the one who perpetuated and legalized corruption in
Nigeria.
"For instance, he was the brain behind the formation of Transcorp Company for which he
bought over two million shares while in office as president and Transcorp Hilton, the premier
hotel in Nigeria is partly owned by Obasanjo. The same Transcorp company bidded for power
facilities being privatized, after Obasanjo had spent over 15 million dollars on the same power
facilities as exposed by the Elumelu Committee of the House of Representatives.
"Secondly, he forced Nigerian businessmen and bankers to donate to his presidential library in
Ota. Was he out of office when the Bell University was founded? He should tell Nigerians how
much he made from Ota Farms as one of his cronies , Fani Kayode, had once claimed that he
was making N30 million daily. Why has he not announce how much he is making now? One will
also like to know the details of Ota Farms' transaction with Delta State Government, for which
he has received over N3billion.
"We do not want a situation whereby most corrupt former heads of state or presidents pride
themselves as the only person who could fight corruption in Nigeria because they are ready to
die in the eradication of corruption in Nigeria and they cheaply portray to Nigerian public that
Jonathan as president of Nigeria is not ready to die in the process of eradicating corruption in
Nigeria."
Speaking on the Boko Haram insurgents, Clark said; "On the Boko Haram issue, I had given
Obasanjo credit for visiting the Boko Haram den in Maiduguri and challenged his colleagues to
condemn Boko Haram and visit the den as leaders. However, which report is Obasanjo talking
about, which he submitted to President Jonathan and it was not acted upon? What is the
purpose of the letter he jointly signed with Babangida?
"I want Obasanjo to stop parading himself in every corner of Nigeria as a super-president and
thereby looking at other leaders as incapable of solving Nigerian problems, particularly those
created by him."
Obasanjo had last week, during a public lecture in Warri, Delta State, in honour of the President
of the Christian Association of Nigeria (CAN) Pastor Ayo Oritsejafor on the 40th anniversary of
his Christian ministry, scored Jonathan low in the fight against corruption and onslaught against
the Islamist sect, Boko Haram.

Prophet T.B. Joshua gives Nigerian student N26m sponsorship for his PHD at Oxford University


Nigerian Pastor T.B. Joshua, well known for his expansive philanthropic endeavours, shocked congregations at his church, The Synagogue Church Of All Nations (SCOAN) on Sunday 18th November 2012 when it was revealed the he has taken up the responsibility to sponsoring a Nigerian student to complete a PhD programme in the University of Oxford to the tune of £100,000, approximately
N26 million.
Miss Yinka Oduwole, who introduced herself as one of the youth who was brought up in The SCOAN and worked there extensively, testified how she had gained admission to study a PhD in Engineering Science in Oxford University, UK after a successful Master’s Programme in University College London (UCL). Yinka, who was equally sponsored in her Master’s Degree in Broadband Communication in UCL where she came out with a distinction, said Prophet T.B. Joshua and Emmanuel TV Partners had paid the sum of £100,000 to enable her to study for a PhD in the prestigious Oxford University.
“My advice to youth all over the world is that they should pray as if everything depends on God and work as if everything depends on them,” Yinka asserted.
Yinka, also a First-Class graduate from the University of Lagos, had advised the congregation and viewers worldwide on Emmanuel TV, especially the youth to find a job to do in church and actively engage in godly activities.



TB Joshua also revealed in the service how footballer Ogenyi Onazi, the SS Lazio starlet who was recently promoted to the Super Eagles of Nigeria and scored on his debut against Venezuela, was brought up in the church and worked there as well before attaining his current sporting success.
Joshua revealed how he had sponsored Onazi and his colleague Sani Emmanuel to trial in clubs around the world including Premier League giants Chelsea and Tottenham, before arriving in SS
Lazio, where he is currently playing for the senior team.
Joshua had further revealed that close to $1m was spent in the search process, to ensure the duo went to the right club and to get to the heights of their potentials.
According to Joshua, the reward for raising up such young people to become leaders of tomorrow in every field of expertise is immeasurable in monetary or material terms. “What you make happens for others, God makes happen for you. You are raised to raise others,” Joshua exhorted the crowd, counselling them to consider the future of their own children and what they were doing with their lives.
